  • In the United States, law enforcement's use of geofence warrants鈥攃ourt orders compelling tech companies to provide location data for all devices within a specified area and timeframe鈥攊s among the most contentious digital civil liberties issues of our time. Federal courts have struggled to apply existing Fourth Amendment doctrine to such searches, and in the meanwhile, a three-step procedure developed by Google鈥攃urrently the main purveyor of location data to law enforcement鈥攈as been doing most of the work that the law should be doing in channeling how law enforcement agencies conduct searches of geolocation databases.

    On April 19,聽the Byron White Center for the Study of American Constitutional Law and the Silicon Flatirons Center for Law, Policy and Entrepreneurship hosted the 32nd Annual Rothgerber Conference on AI and the Constitution. This year鈥檚 conference was one of the first of its kind to focus on prevalent issues at the intersection of Artificial Intelligence and the Constitution.聽Interdisciplinary scholars, scientists, lawyers and students from around the world gathered at the University of Colorado Law School in Boulder to discuss recent AI developments and the impact on the right to privacy, free speech under the First Amendment, and judicial interpretation.
